Terms of Use
Chapter Bank is committed to transparency, security, and regulatory excellence.
1. Introduction
1.1. These Terms of Use (“Terms”) govern your access to and use of the Chapter Bank website (“Website”), online banking platform, mobile application (“App”), and any associated digital interfaces or services (collectively, the “Platform”).

1.2. By accessing, browsing, or using the Platform, you acknowledge and agree that you have read, understood, and accepted these Terms together with the Chapter Bank Terms and Conditions, Pricing List, Privacy Policy, and any additional agreements applicable to your Account.

1.3. If you do not agree to these Terms, you must immediately stop using the Platform.1.4. In the event of conflict between these Terms and the Terms & Conditions, the Terms & Conditions prevail for banking matters; these Terms prevail solely for Website/Platform use.
2. Definitions
Your Chapter Bank account(s), including personal and/or business banking accounts.“Account” means your Chapter Bank customer account.

C Digital assets including Bitcoin and other supported cryptocurrencies held in custody on your behalf.

Transaction: Any transfer, exchange, payment, or other operation you execute through our Services.

“Platform” means the Website, Online Banking, App, APIs, and all digital interfaces.

“Content” means all data, text, graphics, software, code, and materials on the Platform.

“User” means any person accessing the Platform, with or without an Account.
3. Eligibility & Access
3.1. You may use the Platform only if you:
a. are at least 18 years old;
b. have legal capacity to enter contracts;
c. are not a citizen or resident of the Commonwealth of Dominica;
d. are not sanctioned or owned/controlled by a sanctioned person;
e. have not been previously banned by Chapter Bank.

3.2. Access may require login, identity verification, MFA, or enhanced checks.3.3. We may deny access at our sole discretion.
4. Account Security & User Obligations
4.1. You must keep your credentials, passwords, devices, and authentication secure.

4.2. You must not share logins, allow unauthorized access, use automated tools, or tamper with security controls.

4.3. Notify us immediately of suspicious activity.

4.4. You are responsible for all actions until we are notified.
5. Use of the Platform
5.1. You must use the Platform only for lawful and permitted purposes.

5.2. You may not use the Platform for:
a. fraud, ML/TF, sanctions evasion, or criminal conduct;
b. disrupting systems, servers, or networks;
c. deploying malware, bots, crawlers, or harmful scripts;
d. scraping or extracting data without approval.

5.3. We may monitor activity for AML/CTF, sanctions, fraud, and security purposes.
6. Intellectual Property
6.1. All Content and IP belong to Chapter Bank or licensors.

6.2. You receive a limited, non-transferable license for authorized use.

6.3. You may not copy, reproduce, reverse-engineer, distribute, or commercially use Content without written approval.
7. Acceptable Use Policy (AUP)
7.1. You must not use the Platform for:
a. prohibited industries (weapons, drugs, fraud, illegal goods);
b. sanctioned jurisdictions or individuals;c. high-risk financial schemes (HYIP, Ponzi, etc.);
d. anonymous/proxy/VPN restricted access.

7.2. We may report suspicious activity to regulators, law enforcement, or System Participants.
8. Platform Availabiltiy & Maintenance
8.1. We do not guarantee continuous availability.

8.2. Service interruptions may occur due to maintenance, outages, cyber events, or third-party failures.

8.3. We are not liable for delays, interruptions, or lost data.
9. Third-Party Services & System Participants
9.1. The Platform integrates third-party services, including correspondence banks, payment processors, and cloud providers.

9.2. We are not responsible for their performance, decisions, or outages.
10. API Access
10.1. API access may be granted subject to API terms and restrictions.

10.2. You must not breach rate limits, reverse-engineer, or destabilize services.
11. Privacy & Data Processing
11.1. Personal data is processed per the Privacy Policy and Data Protection Addendum.

11.2. You consent to AML/CTF checks, sanctions screening, behavioral analytics, and data transfers to regulated institutions.

11.3. Cookies, device fingerprints, and security analytics may be used.
12. Termination & Suspension
12.1. We may suspend or terminate access if:
a. you violate these Terms;
b. AML/CTF or sanctions risks exist;
c. we detect fraud or unauthorized access;d. a regulator instructs us.

12.2. Suspension of Platform access does not automatically terminate your banking Agreement.
13. Disclaimers
13.1. The Platform is provided “as is” and “as available.”

13.2. No warranties are made regarding accuracy, availability, reliability, merchantability, or fitness for purpose.

13.3. Nothing constitutes legal, financial, or investment advice.
14. Tax
14.1. Banking offshore may offer tax advantages depending on your jurisdiction. It is your responsibility to understand and comply with your personal tax obligations. You should obtain independent tax advice if unsure.

14.2. Tax information on the Platform is generic and not intended as financial, legal, or tax advice. Legislation may change, affecting your personal situation.
15. Limitation of Liability
15.1. To the maximum extent permitted by law, Chapter Bank is not liable for:
a. loss of profits, income, business, or data;
b. indirect or consequential damages;
c. delays or outages;
d. third-party or System Participant failures.
16. Internet & Email
16.1. Internet messages may be intercepted, altered, or lost. We are not responsible for such events.

16.2. We will never request personal or security information by email. Report suspicious messages immediately.
17. Social Media
17.1. The Bank operates official social media channels and may monitor content posted about it.

17.2. We are not responsible for third-party content on social media.

17.3. Personal data posted on social media may be public and stored outside our control.

17.4. We attempt to respond but cannot guarantee replies.
18. Governing Law
These Terms are governed by the laws of the Commonwealth of Dominica. English is the language of communication and documentation. Exclusive jurisdiction lies with the courts of Dominica.
19. Changes to the Terms
We may update these Terms at any time. Continued use constitutes acceptance.
